Fundraising Event Terms and Conditions
These terms and conditions apply to all those who host a fundraising event on behalf of SickKids Foundation.
- All fundraising events and initiatives for the benefit of The Hospital for Sick Children and/or The Hospital for Sick Children Foundation ("SickKids Foundation") (each, an "Event") must be approved by SickKids Foundation and are subject to these Fundraising Event Terms and Conditions, as amended by SickKids Foundation from time to time (the "Event Terms and Conditions").
- I agree to provide SickKids Foundation with the net proceeds of my Event, along with an accounting, within sixty (60) days after the Event is over. The accounting will include all proceeds, costs and donations (including gifts of goods or services) of my Event. I confirm that any expenses that I incur to run the Event will be reasonable and transparent. I acknowledge that any expenses I incur in hosting the Event are my responsibility and that SickKids Foundation is not responsible for any losses that I may incur in hosting the Event. I will clearly identify to Event participants that the net proceeds of the Event will be given to SickKids Foundation.
- I understand that SickKids Foundation must strictly follow guidelines set by the Canada Revenue Agency and acknowledge that charitable tax receipts for Events cannot be issued in every circumstance. I agree to follow SickKids Foundation's tax receipting policy and will direct any questions about receipting to my Community Events team member.
- "SickKids", "SickKids Foundation", "The Hospital For Sick Children", "The Hospital for Sick Children Foundation" and "In Support of SickKids Foundation" and related logos are trade-marks of SickKids Foundation and The Hospital For Sick Children. Such trade-marks cannot be used without the prior written approval of SickKids Foundation. All promotional materials for the proposed Event must be approved by SickKids Foundation in writing prior to being released to the public. Promotional materials must not imply that SickKids Foundation is involved in the Event as anything other than a beneficiary of the proceeds.
- SickKids Foundation's registered charity business number cannot be used without the prior written approval of SickKids Foundation for each and every use.
- I acknowledge and agree that The Hospital for Sick Children Foundation and The Hospital for Sick Children, their employees, directors, officers, members, agents, successors or assigns (collectively the "Indemnified Parties"), shall not be held liable for any injury, loss or damage, however caused, which the Indemnified Parties may incur resulting from or arising out of my Event.
- I further agree that I will from time to time and at all times hereafter jointly and severally hold harmless and fully indemnify the Indemnified Parties from any and all actions, causes of actions, claims and demands whatsoever which may be brought against or made upon the Indemnified Parties and against all loss, liability, judgements, costs or expenses which the Indemnified Parties may sustain, incur or be put to resulting from or arising out of any act or omission on my part or of my servants, agents, successors or assigns which was done, or purported to have been done, in connection with the Event.
- I agree to conduct my Event in a safe manner and to adhere to all federal, provincial, and municipal laws, including without limitation any and all public health guidelines and measure regarding the prevention and mitigation of spreading infectious diseases such as COVID-19. I will obtain all necessary permits and licenses for my Event. - I will advise participants in my Event of any risks; and, if appropriate (e.g., participating in a sport, being in a motorized vehicle, being in or around water, etc.), I will obtain a waiver of liability from each Event participant (or their parent/guardian if the Event participant is under 18 years of age) in favour of SickKids Foundation.
- I will obtain appropriate insurance for my Event. I acknowledge that the requirement for insurance does not limit my indemnity or other obligations in respect of the Event and that SickKids Foundation does not represent that the insurance and limits required are adequate.
- I agree to respect the confidentiality of personal information that may be provided to me by Event participants.
- I will only use personal information to administer my Event in support of SickKids Foundation.
- I agree that all such personal information is collected on behalf of SickKids Foundation. I will provide all participant information to SickKids Foundation prior to or immediately after my Event or upon request of SickKids Foundation and will destroy all copies after providing such information to SickKids Foundation.
- Personal information of the participants provided shall be kept secure at all times (whether stored in physical form or on a computer); access to personal information shall be limited to myself (as Event organizer) and my employees and volunteers on a "need-to-know" basis; and if any personal information is lost or if there is any unauthorized access, use or disclosure of the personal information, I will immediately notify SickKids Foundation.
- I acknowledge that SickKids Foundation is unable to share its donor list or to supply media contacts to help me promote the Event
- I acknowledge that SickKids Foundation, in its sole discretion, may deny my application and may revoke an accepted application at any time. If SickKids Foundation revokes its approval, I agree to immediately cease all use of any of the SickKids trade-marks and SickKids Foundation may communicate publicly that it is no longer affiliated with the Event. I further agree to immediately give SickKids Foundation any funds raised and an accounting of funds raised up to the date of such revocation.
- I acknowledge that as a general rule, donations to SickKids Foundation shall be used to support SickKids Foundation's highest priority needs.
- Any request to designate your gift for a specific purpose must be approved by SickKids Foundation in advance of your Event; and if approved, must be clearly communicated to all Event participants in advance of the Event.
- If, after acceptance of a designated gift, SickKids Foundation find that it is impractical to continue to apply the gift to the designated purpose, SickKids Foundation may re-designate the purpose of the gift (having regard to the original intent of the gift).
- In order to assist with SickKids Foundation's costs, including processing, receipting, investment management, stewardship and granting of designated (or restricted) gifts, a percentage of the gift will be allocated to SickKids Foundation in accordance with the Foundation's policy. As of the date of these terms, that amount is 10%.
- These Event Terms and Conditions shall, for all purposes, be construed in accordance with the laws in force in the Province of Ontario and the laws of Canada applicable in Ontario, to the complete exclusion of conflict of laws rules. The parties hereby attorn to the exclusive jurisdiction of courts located in Toronto, Ontario.
- These Event Terms and Conditions are in addition to the applicable policies of SickKids Foundation and to the Terms of Use on the SickKids Foundation website. Please note that the Foundation reserves the right, at its discretion, to change, modify, add, or remove portions of its policies or Terms of Use or these Events Terms and Conditions. - These Event Terms and Conditions are binding upon and shall be to the benefit of the parties and to their respective heirs, administrators, legal personal representatives, successors and permitted assigns.
I am at least 18 years of age and I have read and understand the terms and conditions outlined above. If I am signing on behalf of a corporation, I represent and warrant that I have the authority to bind the corporation.
